Authority: Municipal Code, Chapter 323-13. Chair shall conduct Appeal Hearings, Vice -Chair shall conduct hearings in absence of the Chair. Contract Compliance Staff shall conduct new members orientation with all CCAB members prior to the members participation at an Appeal Hearing. All CCAB members shall be provided a copy of CMC 323, these bylaws, the SBE Rules, Guidelines and a copy of the Hearing Procedures 7 total members plus (2) two alternates and three SBE/ City Staff

Purpose: Board shall make recommendations to the City Manager for appeals resulting from a denial of certification as a Small Business Enterprise (SBE); revocation of certification due to a noncompliance with the requirements of CMC 323; and penalties or sanctions that are applied against firms for violations.

Meeting Schedule: Board shall set a hearing date not more than twenty-eight (28) days from the date of receipt of the notice from the Contract Compliance Officer or other designated City Staff person. All hearings shall be open to the public. Within 7 business days of the conclusion of the hearings, the board shall make written recommendations to the City Manager or City Managers designee on teh appeal, which recommendation shall affirm, modify or reverse the determination of a noncompliance or the denial of certification by the board. The City Manager shall issue written notice (30) thirty days the decision of the appeal to all parties after receiving the recommendation of the board.

Appointment: Members: 4-7 Voting Members appointed to terms of no more than two (2) years by the City Manager. Members shall be appointed for not more than two (2) consecutive terms not exceeding four years. If there are extenuating circumstances, staff may recommend one additional term for a member. The City manager shall fill all vacancies occurring during a term for the remainder of a said term in accordance with the terms of membership. Nomination for appointments will be submitted to teh City Manager by City Staff. City Manager or City Managers shall appoint a Chair and Vice-Chair.
