Breached Agreements

A successful Mediation will result in a written agreement, which is electronically signed by both parties and the Mediator. 

The agreement will be kept in a confidential file with the City Mediation Program and each party will receive a copy of the agreement. 

When one party does not do something that was agreed upon, that party may be in BREACH of the agreement. 

The first step in deciding what to do in a breached agreement is to follow any agreed steps that the parties put in the agreement. If those steps have been followed, you should report the breach to the City Mediation Program by emailing CityMediation@cincinnati-oh.gov or by calling our Mediation Program Coordinator at 513-352-3354. 

Possible next steps might include: contacting the other party to discuss or modify the agreement; scheduling another Mediation session; referring the party or parties to community resources; and, as a last resort, considering whether to pursue criminal action on the original dispute. If the breach rises to the level of a criminal offense, it will be reviewed in the same manner as the original dispute.
