Cincinnati Municipal Code 325 (CMC 325) and City Council Resolution 21 (R-21) govern EEO requirements for City contractors. CMC 325 applies to all written agreements between the City and another party where the City expends or receives funds in excess of $5,000 for the construction of any public improvement, purchase of services, or lease of any real property to or from another party. For all City construction work, R-21 sets a standard of 11.8% minority male hours, 6.9% female hours, of which 3.45% should be minority female hours, in the Hamilton County area. These percentages apply to all craft trades used on all City construction projects. The City’s EEO Poster must be posted in a location visible to all employees and applicants for employment.
Equal Employment Opportunity Reporting
The Department of Economic Inclusion tracks each contractor’s compliance with CMC 325 and R-21. For the purposes of tracking a contractor’s progress towards the goals set by R-21, a monthly employment utilization report must be submitted. On projects that are subject to prevailing wage and where the contractor has submitted information into the City’s LCP Tracker system, a monthly employment utilization report can be generated by the City from LCP Tracker based on the information submitted by a contractor so no additional documentation is required for those work hours. For a contractor’s employee hours on a city funded construction project that are not submitted into LCP Tracker (for non-prevailing wage City work), a utilization report (Form 257) must be submitted to the Department of Economic Inclusion on a monthly basis.
The Department of Economic Inclusion reviews each EEO Form 147 submitted by a contractor as a part of a bid submission. The City may periodically request additional information from the contractor to determine the company’s ongoing compliance with Cincinnati Municipal Code 325.
