Code Enforcement Process for Graffiti

Per CMC Sec. 751-1-G, "Graffiti" shall mean any inscription, word, figure, marking or design that is marked, etched, scratched, drawn or painted on any premises, including buildings, structures, fixtures or other improvements, whether permanent or temporary, whether public or private, without the consent of the owner of the property, a person in control, or the owner's authorized agent, and which is visible from the public right-of-way or other public or quasi-public location within the city. 

  • A Notice of Violation shall be issued to the owner or persons in control.
  • Within thirty days of the date of receipt of this notice, the owner or person in

 control must either remove the graffiti or appeal the notice of violation by submitting a petition for written determination.

  • If after 30 days and upon reinspection, you have not removed the graffiti or filed the petition for written determination of violation, the property shall thereafter be deemed a nuisance property and a referral is sent to the Abatement Program (to be painted/removed by a city contractor) .
  • The total cost for the abatement services provided by the City is invoiced to the property owner and if not paid in a timely manner may be assigned to collections or an assessment in the form of a tax lien against the property.
