About The Zoning Board of Appeals

The Zoning Board of Appeals (ZBA) has the duty to hear all appeals arising out of the Cincinnati Zoning Code. ZBA is an administrative method to appeal the decision from the Zoning Hearing Examiner, decisions of the Historic Conservation Board, issuance of a permit or Certificate of Compliance and zoning violation orders.

Any person or entity affected by the aforementioned items has 30 days from the date of these actions to file an appeal.

The ZBA conducts public hearings and decides applications for Urban Design Overlay District development permissions.

How To File An Appeal?

Appeals to the Zoning Board of Appeals (“ZBA”) involve a two-step process. The ZBA will not schedule a hearing unless the appellant satisfies all necessary requirements before the applicable deadlines. All appeal application transactions must be completed by 4:00 p.m. No exceptions.

Phase I: Notice of Appeal

  • A completed application form
  • A letter explaining in details the reason for filing the appeal
  • A copy of the decision, order or letter being appealed.
  • A non-refundable application fee: $300

Phase II: Perfection of the Appeal

All appeals from a hearing require the appellant to file a full record of that hearing, including a notarized transcript. The appellant bears the burden of producing the full record, including transcription fees.

The appellant must file nine (9) copies of the full record and notice of appeal within 21 days of filing the notice of appeal. All filings must be bound, indexed, and numbered with a table of contents. The filing must include the following documents:

  • All documents from the Phase I filing (application, justification letter, copy of decision)
  • Notarized transcript from the hearing
  • Full record of the hearing
  • Nine copies bound, indexed, and numbered with a table of contents
  • One digital copy provided by CD, or USB flash drive

How To File An Urban Design Overlay District Application?

If you require the Zoning Board of Appeals approval for the relief you are seeking, you must submit nine hard copies and one digital USB flash drive of the following:

  • your application;
  • denial letter from Zoning Department, or signed letter from Zoning Plans Examiner; 
  • all materials required to support your application outlined in the application checklist; and
  • the required application fee.

An application will not be deemed complete until all required documents have been submitted and the application fee is paid in full. All transactions must be completed by 4:00pm. No exceptions.  

Applicants are strongly encouraged to submit as early as possible to allow time for review and revisions. Partial applications cannot be processed. Failure to submit a complete application prior to 4:00pm on a deadline date will result in delays to the assigned hearing date.

Hearing Information

You have the right to review the documents associated with a case and attend the public hearing. For specific information about an appeal, case or general questions about the hearing process contact Kasandra Maynes at 513-352-1559.

The Zoning Board of Appeals usually meets the third Thursday of each month in the Fifth Floor Conference Room at the Business Development and Permit Center, 805 Central Ave., Suite 500, but all meeting dates are subject to a quorum confirmation.
