Wage Enforcement Document Submission
When a contract is subject to the Wage Enforcement Ordinance, the following documents must be submitted:
Contractor/Subcontractor Utilization Plan (WE-20) - This form must be submitted by the company holding the contract with the City of Cincinnati and approved by the Department of Economic Inclusion prior to the commencement of construction. Once this form has been submitted, if additional subcontractors are to be utilized, a supplemental WE-20 must be submitted for approval of those subcontractors. A form WE-20 also must be submitted by each contractor or higher-tier subcontractor working on the City project that intends to subcontract any work prior to the commencement of work by any its proposed subcontractors.
Affidavit Regarding Wage Theft or Payroll Fraud (WE-30) – This form must be completed by the company holding the contract with the City of Cincinnati and submitted prior to execution of the contract. A separate WE-30 also must be completed by each contractor or subcontractor that is to perform work under the contract and submitted with the Contractor/Subcontractor Utilization Plan (WE-20) for approval by the Department of Economic Inclusion.
When a contract is subject to the Wage Enforcement Ordinance, these additional documents may be necessary:
Supplemental Affidavit Regarding Wage Theft or Payroll Fraud (WE-40) - Any developer, contractor or subcontractor that becomes the subject of a complaint or Adverse Determination of Wage Theft or Payroll Fraud (as defined by CMC 326-2-W and CMC 326-2-P1, respectively) during the term of the contract must file this updated affidavit with the Department of Economic Inclusion within 30 days of being notified of the complaint or adverse determination.
Notice of Appeal or Contest of Adverse Determination of Wage Theft or Payroll Fraud (WE-70) - Any developer, contractor or subcontractor against which an Adverse Determination of Wage Theft or Payroll Fraud has been made may use this form to notify the Department of Economic Inclusion that the Adverse Determination is under review, has been formally contested, or has been appealed.
Complaint or Report of Wage Theft or Payroll Fraud (WE-50 and WE-60)) – The company holding the contract with the City of Cincinnati has an affirmative obligation to report to the Department of Economic Inclusion any complaints or allegations of Wage Theft or Payroll Fraud made against itself or against any of its contractors or subcontractors of which it becomes aware. If there has been no formal complaint filed with the U.S. Department of Labor, the Ohio Department of Commerce, or any other agency with the jurisdiction to investigate and adjudicate those allegations, the information should be reported on a Complaint of Wage Theft or Payroll Fraud (WE-50). A Report of Wage Theft or Payroll Fraud (WE-60) is used to report a complaint against the developer, contractor or subcontractor that has been filed with another agency.
